PATENTS AND UTILITY MODELS:

They are new gadgets or inventions that involve an inventive step and are subject to industrial application. The differences between the two registries are the global novelty of the patent (research carried out by the Patent Office on the world’s documentary fund), versus the national utility model and the protection that varies from 20 years in the case of patents and 10 in the case of utility models.

1* Full name, address and tax identification number of the applicant (physical person/s, or legal entity).

2* In the case of legal entities, indicate the name of the inventor, domicile and tax identification number.

3* Description of the invention, in as much detail as possible.

4* Drawings or plans.

5* Authorization signed by the applicant (name and position of signatory). Download authorization

The three requirements that an invention must fulfil are:

  • Novelty: it is considered to be an invention which is new when it is not included in the Technical State of the Art.
  • Inventive activity: it is considered an invention if it involves an inventive activity which does not result from the the Technical State of the Art in a manner evident to one knowledgeable in the material.
  • Industrial application: it is considered that an invention is subject to industrial application when its object can be manufactured in any type of industry, including agricultural.
INDUSTRIAL DESIGNS:

Industrial designs are the external shape of a product (a bottle, a piece of jewellery, etc.), creations that do not report a utility, but only its exterior appearance.

2* Drawings, pictures or a copy of the design to be protected.

TRADEMARK:

 

Trademark refers to any sign or medium that distinguishes or serves to distinguish products or services of a person or entity on the market, from other identical or similar products or services of another person on the market. In addition, a trademark identifies its company origin (distinctive to the product or services, which can be a name, logo or combination of both).

2* Name and / or logo to be registered.

TRADE NAME:

A trade name refers to a sign or denomination used to identify a natural or legal person in the course of his or her business and distinguishes his activity from other identical or similar activities.
